At least four different frameworks — psychiatric, cognitive, functional and decision-making — are used in the evaluation of competence, all of which remain more or less unrelated in the literature. In the first section of this paper we consider various meanings of competence, in order to arrive at a definition of the term relevant to the medical and legal setting. Patient or client competence, we conclude, refers to the practical abilities that individuals employ in pursuing their own autonomous goals in (...) life. We then show how a systematic categorization of these practical abilities — which we call a taxonomy of practical judgment — allows us to show when the traditional frameworks for the evaluation of competence may or may not be useful in the evaluation of a particular competence.In the final section we explore some of the normative considerations underlying the taxonomy. For instance, competence is not only related to intrinsic abilities but to resources available in the community. Here we touch on questions related to the fair distribution of community resources. Based on the relevant logic R, the system R# was proposed as a relevant Peano arithmetic. R# has many nice properties: the most conspicuous theorems of classical Peano arithmetic PA are readily provable therein; it is readily and effectively shown to be nontrivial; it incorporates both intuitionist and classical proof methods. But it is shown here that R# is properly weaker than PA, in the sense that there is a strictly positive theorem QRF of PA which is unprovable in R#. (...) The reason is interesting: if PA is slightly weakened to a subtheory P+, it admits the complex ring C as a model; thus QRF is chosen to be a theorem of PA but false in C. Inasmuch as all strictly positive theorems of R# are already theorems of P+, this nonconservativity result shows that QRF is also a nontheorem of R#. As a consequence, Ackermann's rule γ is inadmissible in R#. Accordingly, an extension of R# which retains its good features is desired. The system R##, got by adding an omega-rule, is such an extension. Central question: is there an effectively axiomatizable system intermediate between R# and R##, which does formalize arithmetic on relevant principles, but also admits γ in a natural way? (shrink)

The aim of the paper is to draw a connection between a semantical theory of conditional statements and the theory of conditional probability. First, the probability calculus is interpreted as a semantics for truth functional logic. Absolute probabilities are treated as degrees of rational belief. Conditional probabilities are explicitly defined in terms of absolute probabilities in the familiar way. Second, the probability calculus is extended in order to provide an interpretation for counterfactual probabilities--conditional probabilities where the condition has zero probability. (...) Third, conditional propositions are introduced as propositions whose absolute probability is equal to the conditional probability of the consequent on the antecedent. An axiom system for this conditional connective is recovered from the probabilistic definition. The role of contingent contexts in formulating relations between properties of systems at different descriptive levels is addressed. Based on the distinction between necessary and sufficient conditions for interlevel relations, a comprehensive classification of such relations is proposed, providing a transparent conceptual framework for discussing particular versions of reduction, emergence, and supervenience. One of these versions, contextual emergence, is demonstrated using two physical examples: molecular structure and chirality, and thermal equilibrium and temperature. Drawing from an astounding array of sources, Nussbaum argues against the common understanding of emotions as irrational and animalistic impulses disconnected from our thoughts and reason. Rather, she argues that emotions are highly discriminating responses to what is of value and importance that are, therefore, suffused with intelligence and discernment. This volume collects thirty years worth of articles on the emotions written by the distinguished philosopher Robert Solomon. Solomon's thesis is that we are significantly responsible for our emotions, which are evaluative judgments that in effect we choose. This is the first of several volumes that document work in the emotions.

Classically, gratitude is a tri-polar construal, logically ordering a benefactor, a benefice, and a beneficiary in a favour-giving-receiving situation. Grammatically, the poles are distinguished and bound together by the prepositions ”to’ and ”for’; so I call this classic concept ”to-for’ gratitude. Classic religious gratitude follows this schema, with God as the benefactor. Such gratitude, when felt, is a religious experience, and a reliable readiness or ”habit’ of such construal is a religious virtue. However, atheists have sometimes felt an urge or (...) need for an analogous experience and virtue of gratitude, and theists sometimes feel intellectual discomfort with classical theistic gratitude on consideration of the misfortunes that characterize our life along with its blessings. In response, another conception of religious gratitude has been attempted, a construal that lacks the to-for structure. This paper probes the significance of the benefactor for gratitude, both secular and religious, and, with Søren Kierkegaard’s help, some features of the theology of classical religious gratitude that dissolve the problem of misfortunes. This paper highlights the difference between Lilian Bermejo-Luque’s account of warrants with the quite different accounts of warrants offered by Toulmin, Hitchcock, and myself, and lays out some of the reasons why I think a “Toulminesque” account of warrants captures crucial aspects of arguing more adequately than her account does.

There has been a long-standing debate about the relationship of predictability and determinism. Some have maintained that determinism implies predictability while others have maintained that predictability implies determinism. Many have maintained that there are no implication relations between determinism and predictability. This summary is, of course, somewhat oversimplified and quick at least in the sense that there are various notions of determinism and predictability at work in the philosophical literature. In this essay I will focus on what I take to (...) be the Laplacean vision for determinism and predictability. While many forms of predictability are inconsistent with this vision, I argue that a suitably restricted notion of predictability, consistent with the practice of physicists, is implied by the Laplacean notion of determinism. It is argued that limitations on predictability are of an in principle nature in the Appendix. (shrink)

Determinism is a rich and varied concept. At an abstract level of analysis, Jordan Howard Sobel (1998) identifies at least ninety varieties of what determinism could be like. When it comes to thinking about what deterministic laws and theories in physical sciences might be like, the situation is much clearer. There is a criterion by which to judge whether a law–expressed as some form of equation–is deterministic. A theory would then be deterministic just in case all its laws taken as (...) a whole were deterministic. In contrast, if a law fails this criterion, then it is indeterministic and any theory whose laws taken as a whole fail this criterion must also be indeterministic. Although it is widely believed that classical physics is deterministic and quantum mechanics is indeterministic, application of this criterion yields some surprises for these standard judgments. In "The Compatibility of Naturalism and Scientific Realism" (Dec. 2003) , Brian Holtz offers two objections to my argument in "The Incompatibility of Naturalism and Scientific Realism" (in Naturalism: A Critical Appraisal , edited by William Lane Craig and J. P. Moreland, Routledge, 2000). His responses are: (1) my argument can be deflected by adopting a pragmatic or empiricist "definition" of "truth", and (2) the extra-spatiotemporal cause of the simplicity of the laws need not be God, or any other personal (...) being. Quons are particles characterized by the parameter q, which permits smooth interpolation between Bose and Fermi statistics; q = 1 gives bosons, q = -1 gives fermions. In this paper we give a heuristic argument for an extension of conservation of statistics to quons with trilinear couplings of the form ffb, where f is fermion-like and b is boson-like. We show that q f 2 = qb. In particular, we relate the bound on qγ for photons to the bound on (...) qe for electrons, allowing the very precise bound for electrons to be carried over to photons. An extension of this argument suggests that all particles are fermions or bosons to a high precision. (shrink)

The concept of contextual emergence is proposed as a non-reductive, yet welldefined relation between different levels of description of physical and other systems. It is illustrated for the transition from statistical mechanics to thermodynamical properties such as temperature. Stability conditions are crucial for a rigorous implementation of contingent contexts that are required to understand temperature as an emergent property. It is proposed that such stability conditions are meaningful for contextual emergence beyond physics as well.

Horror is not the same as fear, and while fear contains an essential action tendency horror does not. And while we can enjoy fear there is no enjoying of horror.

In this paper, I argue that pragmatism, at least in its formulation by William James, squarely addresses the metaethical and normative issues at the heart of our present crisis in moral justification. James gives ethics an empirical foundation that permits the natural and social sciences a clear role in defining our obligation to the wider environment. Importantly, James’ pragmatism also addresses the psychological and cultural factors that help elicit our willingness to adopt an ethical posture toward life.

Justice is typically treated in philosophy and political science as a matter of theory and reasoning. I argue instead for a conception of justice based first of all on emotions, in particular, the emotions of compassion, caring, and vengeance.

Proponents of the dominant paradigm in evolutionary psychology argue that a viable evolutionary cognitive psychology requires that specific cognitive capacities be heritable and “quasi-independent” from other heritable traits, and that these requirements are best satisfied by innate cognitive modules. We argue here that neither of these are required in order to describe and explain how evolution shaped the mind.

The types of cetacean cultural behavior patterns described (primarily food-related and communication-related) reflect a very different research focus than that found in primatology, where dietary variation and food processing is emphasized and other potentially patterns have (until recently) been relatively neglected. The lack of behavioral research in all but a few cetacean species is also notable, as it mirrors a bias in primatology towards only a few genera.
